01Seller, Customer and scope
The Seller under this public offer is [Company name / TIN], trading as LOOT ROOM and having its registered address at [registered address]. The Seller's contact details are [telephone / WhatsApp number], [email address] and [website domain].
A Customer is an individual or legal entity that places an order on the website or enters into a sale contract with the Seller. An individual purchasing for personal, family or household purposes is protected by the mandatory consumer laws of the Republic of Azerbaijan.
This document sets out the general terms for website sales of Pokémon TCG single cards, booster packs and boxes, Elite Trainer Boxes, tins and accessories. The product page, final order summary, Pre-order Terms, Delivery, Returns and Refunds Policy and Privacy Policy form an integral part of these terms.
02Public offer and formation of the contract
This document is a public offer addressed to an indefinite group of persons. By submitting an order on the website and ticking the relevant consent box, the Customer confirms that they have read and accept the terms applicable to the order.
An automatic website notice acknowledging an order only confirms that the request has reached the Seller. Because stock and pre-order prices are checked manually, the contract is formed when the Customer receives the Seller's WhatsApp message confirming the product, quantity, status, final price, payment and handover terms.
If the terms in the Seller's WhatsApp message differ from the order submitted on the website, that message is a new offer. In that case, the contract is formed only when the Customer gives written acceptance or makes the agreed payment; silence does not constitute acceptance.
03Products and accuracy of information
LOOT ROOM sells collectible cards and related products imported from abroad. The product name, language, release, contents, sealed or single-card status, condition of a single card and other material characteristics are stated on the product page and in the order confirmation.
Images may be illustrative; where a photograph depicts the exact single card offered for sale, this is stated separately. Products with random contents, including boosters, boxes, ETBs and tins, do not guarantee any specific card, rarity, value or game outcome.
The Seller seeks to keep information accurate, but an obvious technical, typographical or pricing error does not entitle a party to performance on the erroneous term. If an error is found before confirmation, a corrected term will be offered; if found after confirmation, the parties will agree a correction or cancellation with a full refund.
04Placing and confirming an order
The Customer adds products to the cart, enters contact and handover details, selects a payment method and submits the order. The Customer is responsible for the accuracy of the name, telephone number, email and address provided and for ensuring that any person accepting the order is authorised to do so.
The Seller checks the order through WhatsApp and states whether the product is in stock or a pre-order, the total amount, delivery fee, estimated timing and required advance payment. Before confirmation, the Customer may correct obvious input errors through WhatsApp and cancel a pending order without charge.
A product is reserved for the Customer only after WhatsApp confirmation and any required payment. The Seller may cancel an order if reasonable attempts to contact the Customer receive no response or the agreed payment is not received within the period specified at confirmation.
05Prices
All prices are stated in Azerbaijani manats. The confirmed product price includes taxes applicable by law, while the courier fee is shown separately and added to the final order total.
Once the contract has been formed, the price of an in-stock product is not changed unilaterally. A promotion, discount or later price change does not apply retrospectively to an order already confirmed.
A price on a pre-order page may be an estimate because of supplier pricing, exchange rates, international freight and import costs. The final price is stated in the WhatsApp confirmation, and if the Customer does not accept it, the order is cancelled without penalty and any amount received is refunded in full.
06Payment
Payment is currently accepted in cash to the courier or at pickup, or by bank transfer to the details supplied by the Seller during confirmation. For a bank transfer, the order number must be included in the payment reference, and payment is complete when the funds are credited to the Seller's account.
A deposit of [deposit percentage]% or another advance payment stated in the WhatsApp confirmation may be required for a pre-order. The balance is paid before or upon handover as confirmed by the parties.
Online card payment through a local payment gateway will become available only after it is activated on the website. Once launched, card transactions will be processed by a licensed payment provider, and LOOT ROOM will not store the full card number or security code on its own server.
07Delivery and pickup
Courier delivery is available within Baku in [Baku delivery zones]. The delivery fee is calculated under [delivery fee amounts], displayed during checkout and finalised in the WhatsApp confirmation.
Pickup from [pickup address and opening hours] in Baku is free and is available only after the Customer has been notified that the product is ready. If the order is not collected within [order pickup holding period], the Seller may release the reservation and cancel an unpaid order after attempting to contact the Customer.
The Customer must provide an accurate address, any access restrictions and a working telephone number. If an agreed handover attempt fails for a reason attributable to the Customer, a new delivery time and fee will be agreed separately.
The risk of accidental loss or damage passes to the Customer upon physical handover to the Customer or their authorised recipient. Title passes after the product has been paid for in full and handed over.
08Pre-orders
A pre-order is an order for a product that is not held in the Seller's stock and is ordered for the Customer from a foreign supplier. The usual estimated arrival time is 2–5 weeks from the later of the WhatsApp confirmation and receipt of the required deposit or payment.
This time is not guaranteed and may change because of supplier processing, international transport, customs, public holidays or other events outside the Seller's reasonable control. The Seller will communicate a material delay; if the revised timing is unsuitable, the Customer may choose to wait or cancel the pre-order and receive a full refund of the amount paid for that product.
If the Customer withdraws from the electronic contract within the period provided by law, any deposit or advance payment received will be refunded in accordance with law. After that period and once the order has been placed with the foreign supplier, a cancellation without fault by the Seller may result in a deduction from the deposit only for the Seller's documented costs that the supplier will not refund and only to the extent permitted by law; the balance will be returned.
If the supplier cannot supply the product, reduces the allocated quantity or the Seller otherwise cannot fulfil the pre-order, the Customer may accept an alternative product or receive a refund of all payments for that product within 7 days. No deduction is made from the deposit when the Seller cancels.
09Order cancellation
The Customer may cancel a pending order without charge through WhatsApp or email before the WhatsApp confirmation is sent. After confirmation, rights to withdraw from the electronic contract, exchange or return are exercised under applicable law and the Delivery, Returns and Refunds Policy.
The Seller may cancel all or part of an order if the product is not actually available, the supplier fails to fulfil it, there is an obvious pricing error, payment is not received, there is a security or fraud risk, or lawful fulfilment is otherwise impossible. The Seller will give the reason and refund the amount received for the unavailable product within 7 days.
Where possible, a refund is made through the original payment method. Cash is refunded at the returns point or in another manner agreed by the parties, while a bank transfer is returned to the payer's verified account.
10Single-card condition and authenticity
Ungraded single cards may be described on the product page as NM, LP, MP, HP or DMG. NM means a card with minimal handling wear but possible minor manufacturing imperfections; LP means light edge or surface wear; MP means visible wear, scratches or edge defects.
HP means significant wear, crease marks, bending or surface damage, while DMG means damage materially affecting integrity or appearance. These labels are descriptive assessments used in the collectibles market, not a professional third-party grade or a guarantee of any future grade.
For a graded card, the stated assessment and score belong to the independent grading company named on the sealed slab. LOOT ROOM does not guarantee that company's decision, that the same score will be awarded upon regrading, or that the grade remains valid after the slab is opened.
LOOT ROOM obtains products from sources it considers reputable and sells cards as genuine to the best of its knowledge. If a card is confirmed to be counterfeit or different from the listed product, the Customer retains all statutory rights to exchange, terminate the contract and receive a refund; changes in market price, investment return or future grade are not product defects.
11Acceptance, exchange and return
At handover, the Customer should inspect the integrity of the parcel, the product name, quantity and visible condition and, where possible, report an obvious discrepancy to the courier and immediately to the Seller. Failure to make a note at handover does not remove statutory rights concerning a hidden defect that could not then be discovered.
The rules on withdrawal from an electronic contract, exchange of a proper-quality product within 14 days, defective products and refunds are set out in detail in the Delivery, Returns and Refunds Policy. If this document conflicts with a mandatory statutory right, the statutory right prevails.
Failure to obtain a desired card from a sealed random-content product, manufacturer-unadvertised differences in weight or card distribution, or a market value below expectations are not defects in themselves. Rights concerning defective products remain available if the packaging or product is actually damaged, incomplete, counterfeit or not as described.
12Liability and events outside control
The Seller is liable for direct and proven loss caused to the Customer by a breach of contract to the extent provided by the laws of the Republic of Azerbaijan. Nothing in these terms excludes the Seller's liability for wilful misconduct or gross negligence, a defective product, unlawful processing of personal data, or consumer rights that may not lawfully be limited.
The Seller is not liable for loss caused by the Customer storing or using a product contrary to its description and ordinary purpose, altering protective packaging, the act of a third party, or a change in a card's play or resale value. Without affecting the Customer's right to recover loss provided by law, indirect and speculative commercial losses are not recoverable.
If a natural disaster, war, government restriction, customs hold, widespread transport disruption or a similar event outside a party's reasonable control delays performance, the affected party will inform the other and seek to mitigate the effects. Such an event does not remove the Seller's statutory duties to give notice and refund payment for a product it cannot supply.
13Intellectual property and independent status
Pokémon, Pokémon TCG and related names, characters, logos and images are trademarks or copyrighted works of their respective owners. They are used solely to identify and describe the products offered for sale.
LOOT ROOM is an independent retailer and is not affiliated with, funded by or endorsed by Nintendo, Creatures, GAME FREAK or The Pokémon Company. Text, photographs and design elements of the website owned by LOOT ROOM may not be used commercially without prior permission except as permitted by law.
14Disputes, changes and contact
A question or complaint about an order may be sent with the order number, a description of the issue and any photographs through [telephone / WhatsApp number] or [email address]. The Seller will investigate within a reasonable time and comply with statutory response and remedy periods.
The parties will first seek to resolve a dispute through negotiation. If no agreement is reached, the Customer may apply to the competent consumer protection authority or a court of competent jurisdiction in the Republic of Azerbaijan; this offer is governed by the laws of the Republic of Azerbaijan.
The Seller may update these terms when the law, its operations or the website changes. A new version applies to orders after the date shown on the website, while a contract already formed remains governed by the version in effect at WhatsApp confirmation, except for a change more favourable to the Customer or a mandatory legal requirement.
